Danielle Lloyd sues Carphone Warehouse after employee 'tried to sell explicit pictures downloaded from her mobile' 24th March 2009
Glamour model Danielle Lloyd is suing a phone company after an employee allegedly tried to sell sexually explicit photos downloaded from her mobile phone.
The photos are believed to include intimate pictures of the 25-year-old's body before and after surgery for suspected breast cancer.
An employee of Carphone Warehouse apparently touted the pictures to national newspapers last year.
He is said to have taken copies of the photos after Danielle bought a new mobile and asked for data from her old phone to be transferred.
She was told to leave her phone with him at the shop and collect it later that day.
In March last year, she learned he had tried to sell the images to at least five newspapers.
She is now suing both the employee and Carphone Warehouse for up to £50,000.
In a claim form to the High Court, Danielle says she has 'suffered great mental distress and shock' after discovering the photos had been seen, copied and sent across the country.
Despite stopping the images from being published so far, Danielle, who regularly poses topless for tabloid newspapers and men's magazines, is still worried they haven't been destroyed and could still appear.
In a statement her lawyer told MailOnline that at the time the 'very private' photos appeared Danielle had still been recovering from the 'shock of a cancer scare which resulted to surgery to her breast.'
The claim says Danielle suffered considerable trouble and expense in stopping the images being published, which the Carphone warehouse had refused to reimburse.
The employee, who worked at a store in London, has refused to answer questions about his actions.
A spokesperson for Carphone Warehouse said in a statement today: 'The download of customer content is entirely unacceptable and we can confirm that this content was not published.
'When the matter was brought to our attention we immediately conducted an investigation and the employee is no longer working within the business.
'Their actions are not indicative of our usual standard of service and we absolutely apologise to Ms Lloyd.'
The claim was submitted at the end of January and is being processed.
A lawyer for the model said Danielle was 'astonished' to hear that the company had apologised.
'Danielle has been seeking an apology for over a year,' her lawyer said in a statement.
